1. Introduction
These Terms and Conditions govern your use of the services provided by Checkmat Waterford, located at Unit 2, Johnstown Business Park, Waterford City, Co. Waterford, Ireland, X91 AFE4. By accessing our facilities or using our services, you agree to be bound by these Terms and Conditions in accordance with Irish law.
2. Membership Terms
Membership is subject to the following conditions: All members must complete a registration form and provide accurate personal information. Members under 18 years of age require parental or guardian consent. Membership is non-transferable and for personal use only. We reserve the right to refuse or terminate membership at our discretion. Members must adhere to all gym rules and codes of conduct.
3. Payment Terms
All fees are payable in advance as specified in your membership agreement. Prices are displayed in Euro (€) and include VAT where applicable. We accept payment by automatic card payment only. Failed payments may result in the suspension of membership privileges. Any changes to membership fees will be communicated with at least 30 days' notice.
4. Cancellation and Refunds
You have the right to cancel within 14 days of purchase and receive a full refund (cooling-off period), unless services have already been fully provided at your request. After the cooling-off period, membership cancellations require 30 days' written notice. Approved refunds will be processed within 14 days. No refunds will be provided for unused classes or training sessions during an active membership period after the cooling-off period has expired.
5. Membership Freezing
Membership freezing may only be requested in the event of an injury and is subject to the following conditions: The minimum freeze period is one (1) month. The maximum freeze period is two (2) months. After two (2) months, the membership will be automatically reactivated. If the monthly membership payment is not successfully processed within five (5) days of reactivation, the membership will be automatically cancelled. A re-registration fee of €15 will apply if the member wishes to rejoin after cancellation. If a member wishes to return before the end of the agreed freeze period, the full membership fee for that month will be payable. If a membership payment remains unpaid for more than five (5) days after its due date, a late payment fee of €5 will be applied.
6. Health and Safety
For your safety and the safety of others: Members must disclose any medical conditions that may affect their ability to train safely. Participation in all activities is at the member's own risk. We recommend consulting a medical professional before beginning any exercise programme. Members must follow all safety instructions provided by staff. Personal hygiene standards must be maintained at all times, including clean training attire and trimmed fingernails and toenails. Members must not participate in training if they have a skin infection or any contagious condition. During Brazilian Jiu-Jitsu (BJJ) sessions, all participants must wear a clean white BJJ gi and a rashguard underneath. During No-Gi sessions, all participants must wear a rashguard and appropriate No-Gi shorts without zippers, buttons, or other hard or sharp components. Patches representing other schools, affiliations, or clubs are not permitted.
7. Code of Conduct
All members must: Treat all members, staff, and visitors with respect and dignity. Refrain from aggressive, discriminatory, abusive, or inappropriate behaviour. Train safely and show respect for training partners at all times. Not attend training while under the influence of alcohol or drugs. Report any concerns regarding safety or conduct to staff immediately. Respect all facilities, equipment, and property. Remain appropriately dressed while inside the gym. Members should use the designated changing facilities when changing clothes.
8. Intellectual Property
All content belonging to Checkmat Waterford, including but not limited to text, images, logos, branding, and training materials, is protected by Irish and international intellectual property laws. Unauthorised reproduction, distribution, modification, or commercial use of any such content is strictly prohibited without prior written permission.
9. Image Rights
The Academy may take photographs and video recordings during classes, seminars, competitions, and events for promotional, marketing, and social media purposes. By joining the Academy, you consent to the use of such images and recordings.
10. CCTV Surveillance
For the safety and security of members, staff, and property, CCTV monitoring operates 24 hours a day, 7 days a week. Cameras are located only in public and common areas and are operated in accordance with applicable data protection legislation.
11. Changes to These Terms
Checkmat Waterford reserves the right to amend these Terms and Conditions at any time. Any material changes will be communicated to members through appropriate channels.
12. Governing Law
These Terms and Conditions are governed by the laws of Ireland. Any dispute arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the Irish courts. Nothing in these Terms and Conditions affects your statutory rights as a consumer under Irish law.
13. Liability
While Checkmat Waterford takes all reasonable precautions to provide a safe training environment, participation in martial arts and fitness activities involves inherent risks. To the fullest extent permitted by law, Checkmat Waterford shall not be liable for any personal injury, loss, damage, or theft of personal property except where such loss or injury arises directly from our negligence or breach of legal duty. Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation would be unlawful under Irish law. We maintain appropriate insurance coverage in accordance with applicable legal and sporting requirements.
